By using this website and placing orders through it, you promise to respect the following limits:
PERSONAL DATA PROTECTION
VIRGINAS informs you, the user of this website, on its policy with respect to the treatment and protection of all personal data which may be gathered by browsing or hiring services through the privacy policy. You may view the privacy policy on our website at any time.
Service availability. When you order items offered through the website, you may request they be delivered either to an address within the Spanish territory, except for the Canary Islands, Ceuta and Melilla, or to a European destination.
Orders are subject to product availability. If any difficulties occur in terms of product supply or if no items remain in stock, VIRGINIAS will inform the customer of this circumstance, by either mail or phone, and will reimburse any amount paid for the unavailable product or products or will exchange the product for another of the same value, in accordance with the customer’s wishes.
Item prices include all taxes in effect but not shipping costs, which will be added to the total cost. VIRGINIAS reserves the right to modify prices at any time, although products will be billed on the basis of the price in effect when the order is made (subject to product availability).
The total price of the product(s), including sales tax, as well as all associated shipping costs will be listed in the purchase order, as explained in the following sections.
The applicable sales tax rate will be the rate legally in force at any given time depending on the specific item in question.
No deliveries will be made to Ceuta or Melilla.
For orders under €30, shipping costs amount to €3.50, except for the Balearic Islands, whose costs will be €14, and €16 for deliveries to the Canary Islands, quantities which must be added to the total amount. Shipping costs will be paid by the customer.
For orders equal to or greater than €35, no shipping costs will be levied (except Canary and Balearic islands).
For orders to any country within the European Union there are no free shipping costs. These should be consulted through the e-mail virginiasonline@virginias.net, amount to be added to the total price. Shipping costs will be paid by the customer.
For orders outside the European Union it is necessary to order by e-mail.
To order through the site, select the item(s) you desire. The items you select will then be added to your shopping cart. The next step will be to place the order and pay. To do so, follow the steps indicated on the website and the purchasing instructions which appear on screen. You will be requested to provide only the information necessary for purchase and subsequent order delivery. Before making your purchase, you must EXPRESSLY ACCEPT the present conditions as well as the privacy policy.
The data gathered by the website will constitute the proof of the transactions made. You will receive confirmation of your order by email.
During the process, before paying, you may modify your order information. Your order will not be registered until the process ends, which will occur once you have made your payment. By clicking “Pay”, you express that you are acquiring and paying for the items selected.
This step represents a binding commitment. There are no limits on purchasing. You may order as many items as you like, with no established lower or upper limits.
VIRGINIAS reserves the right to cancel orders from customers with whom it is engaged in legal dispute.
In addition, VIRGINIAS has the right to refuse or cancel an order for justified reasons, such as:
You may pay by credit/debit card or PayPal. When paying by card or PayPal, the order’s total cost, including any associated shipping costs, will be charged to the customer’s account in the moment of purchase. Only payments in EUROS are accepted.
If, when paying by card, an incident occurs during the process (for example the payment terminal reports that the card has been declined), the order will be cancelled automatically. All card payments must be processed through the Paycomet payment gateway or Bizum.
By clicking “Place My Order”, you are confirming the payment of the order as well as that the credit card is yours. To reduce the risk of unauthorised access, your credit card information will be encrypted. Credit cards will be subject to verifications and authorisations by their issuing entities, but if said entity refuses to authorise the payment, the order will be cancelled automatically, and the system and customer will be notified of the aforementioned cancellation.
If you choose to pay via PayPal, PayPal will be the payment platform, and payment must be made in compliance with this platform’s conditions.
Your order will be sent to the address you have provided to us once the deposit of the total order amount has been confirmed. If the amount has not been paid in full, VIRGINIAS reserves the right not to send the product until the customer has fully paid for it.
Your product will be shipped to the address you provide us. Post boxes will not be considered shipping or delivery addresses.
The delivery period oscillates between 24 and 72 hours (business days) for addresses on the peninsula and Balearic Islands.
The delivery period for addresses outside Spanish territory oscillates between 7 and 10 business days.
The periods indicated will be respected as long as no unexpected or extraordinary circumstances outside our control occur. If for some reason we are unable to deliver your order on time, we will inform you of this circumstance and give you the option to either proceed with your purchase, establishing a new delivery date, or cancel your order with the full reimbursement of the price paid.
As of the writing of the present conditions, it will be understood that the “delivery” has occurred, or that the order has been “delivered”, the moment in which you, or a designated third party, acquire physical possession of the products, which will be accredited through the signing of the reception of the order at the delivery address arranged.
If you are absent from the agreed address at the time of delivery, the shipping agent will attempt to get in contact with you by phone to attempt a second delivery during the same or following day.
VIRGINIAS emphasises the importance of receiving your order in the first delivery attempt. Once 2 days have passed since the initial expected delivery, VIRGINIAS will not be responsible for the products’ state and you will not be able to request the reimbursement of the amount you have paid.
Keep in mind that any transport resulting from the lack of delivery may bear an additional cost, for which VIRGINIAS will be authorised to charge you.
VIRGINIAS does not accept exchanges or returns of its products, given that the right of cancellation does not apply to the remote sale of food, being products whose control of conservation is lost at the time of delivery and which, therefore, may rapidly expire or deteriorate (Art. 103 Section d) of the Rewritten Text approved by RDL 1/2007).
